Vice-President raises concerns about the judiciary’sability to “undo” a Constitutional modificationapproved by Parliament.

On Friday, Vice President Jagdeep Dhankhar stated that the court cannot take the place of the legislative
or the executive since doing so could disturb the system of government.
Dhankar, who is also a Senior Advocate, claimed that in 2015–16 the Supreme Court invalidated a
constitutional modification that had been approved by both the Lok Sabha and the Raya Sabha with no
opposition.He bemoaned the fact that no other democracy in the world could compare such situations.
The Supreme Court’s decision to invalidate the constitutional amendment that would have allowed a
National Judicial Appointments Commission to select judges to the higher judiciary is possibly what the
vice president was pointing to.
