The Bombay High Court made the observation on Wednesday that a licence to carry a firearm is not a right of a person but rather a matter of the government authorities’ discretion to be granted based on perceived threat, which must be proven.
An application for an arms licence from a lawyer who claimed that his life was in danger was being heard by a bench comprising Justices AS Gadkari and PD Naik.
A licence for weapons cannot be issued based solely on a perception of a threat; rather, the threat must be demonstrated to the court, Justice Gadkari noted.
