On Wednesday, the National Company Law Appellate Tribunal (NCLAT) declined to grant Google interim relief in its appeal against a Competition Commission of India (CCI) judgement that penalised the tech giant for abusing its dominant position and assessed a fine [Google LLC v. CCI].
The Bench denied interim relief, noting that the CCI’s order was issued in October 2022 but Google’s appeal was not submitted until December 2022.
The tribunal stated that Google could not be permitted to insist on interim remedy because there was no urgency demonstrated in the appeal’s submission.
