According to a recent ruling by the Kerala High Court [Pappu Bawariya and Another v. District Collector Civil Station and Others], children helping their parents sell pens and other small items cannot be considered to be child labour, and as a result, the police and Child Welfare Committee (CWC) cannot detain children of migrant parents for loitering in the street and selling things.
However, Justice VG Arun emphasised that there is no question that kids should be sent to school rather than be permitted to loiter in the street.
On the subject of poverty, the Court cited Mahatma Gandhi.According to the founding father of our country, “Being poor is not a crime, yet poverty is the worst form of violence.”
