According to a recent ruling by the Rajasthan High Court [Sudhir Sharma v. Chief Secretary, the State Government of Rajasthan and ors], the mere filing of an appeal does not nullify the effects of a divorce decision.
The statement was delivered by a bench comprising Chief Justice Pankaj Mittal and Justice Shubha Mehta in response to a man’s petition challenging the appointment of his estranged ex-wife as a Commercial Assistant, Grade-II.
The appointment was contested on the grounds that it was based on a divorce decision that had not yet become final since there was an appeal ongoing. An appeal was filed before the division bench after the High Court’s single judge had dismissed the matter.
