According to a recent ruling by the Himachal Pradesh High Court, an accused person’s request for bail cannot be rejected only on the basis of how serious the alleged offence is. (Bhupinder Kumar Sharma v. the Central Bureau of Investigation)
The Court cited a number of Supreme Court rulings to reaffirm that an accused person’s punishment doesn’t start until they are found guilty and that every man is presumed innocent until duly tried and proven guilty.
Justice Jyotsana Rewal Dua opined when approving a bail request in a case involving accusations of misappropriating government scholarship funds, into which the CBI is conducting an investigation:”Grant of bail cannot be thwarted merely by asserting that offence is grave “
