In a case involving ABC v. State of Maharashtra & Anr., the Bombay High Court last week approved the termination of a married woman’s 33-week pregnancy after rejecting the medical board’s recommendation to do so due to the length of the pregnancy.
Justices GS Patel and SG Dige, sitting as a divisional bench, noted that the petitioner, an adult married lady, had made an educated decision and that it was her right to decide whether to terminate the pregnancy or not.
The Court emphasised that accepting the request for an abortion would amount to denying the pregnant mother her right to dignity.
